4. Disclaimer of Warranties
The platform is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, except where required by statute. We do not warrant that the platform will be uninterrupted or error-free, or that defects will be corrected.
5. Limitation of Liability
In no event will we, our affiliates, or our licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the platform, including any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.

We may revise and update these terms and conditions from time to time in our sole discretion. All changes are effective immediately when we post them. Your continued use of the platform following the posting of revised terms and conditions means that you accept and agree to the changes.
7. Governing Law and Jurisdiction
These terms and conditions and your use of the platform will be governed by and construed in accordance with the laws of the State of Tennessee without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the federal and state courts located in Knoxville, Tennessee for any actions for which we retain the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of our copyrights, trademarks, trade secrets, patents, or other intellectual property or proprietary rights.
8. Termination
We may terminate or suspend your access to all or any part of the platform at any time, with or without cause, with or without notice, effective immediately.
9. Miscellaneous
These terms and conditions constitute the entire agreement between you and us regarding the use of the platform. If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these terms and conditions will not be deemed a waiver of such right or provision. Any waiver of any provision of these terms and conditions will be effective only if in writing and signed by us.
